1.1. These Website Terms of Use (“Terms”) govern your access to and use of the website located at www.globalxww.com and any related microsites (together, the “Website”), operated by X W W Real Estate L.L.C (“Global X”, “we”, “us”, “our”).
1.2. By accessing, browsing or using the Website in any way, you acknowledge that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy and any other legal notices or policies posted on the Website (collectively, the “Agreement”).
1.3. If you do not agree with these Terms or any part of the Agreement, you must not use the Website.
1.4. You confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Website on behalf of a company or other legal entity, you represent that you are authorised to accept these Terms on its behalf.

2.2. Global X is a real estate brokerage and consultancy based in Dubai, United Arab Emirates, specialising in investment, acquisition and management of real estate assets in Dubai and internationally.
2.3. The Website is provided for general information, marketing and communication purposes only. Nothing on the Website constitutes a binding offer, investment advice, legal advice, tax advice or any form of professional advice, unless expressly stated in a separate written agreement signed with you.
3. CHANGES TO THESE TERMS
3.1. We may update these Terms from time to time, for example to reflect changes in law, our business, or the functionality of the Website.
3.2. When we make material changes, we will update the “Effective Date” at the top of this page. In some cases, we may also take additional steps required by law (for example, notifying you or seeking your renewed consent).
3.3. Your continued use of the Website after any changes have been made will constitute your acceptance of the revised Terms then in force. If you do not agree to the updated Terms, you must stop using the Website.
4. RELATIONSHIP WITH PRIVACY POLICY

8. WEBSITE CONTENT AND NO ADVICE
8.1. All content on the Website, including text, images, videos, property descriptions, floor plans, renderings, 3D tours, brochures, market data, projected returns, and any other information (collectively, “Content”) is provided for general information and marketing purposes only.
8.2. While we endeavour to ensure that Content is accurate, up-to-date and reliable, it may include errors, omissions, typographical mistakes, or become out of date. Content may be based on information provided by third parties (such as developers, owners or marketing partners) and is not independently verified in all cases.
8.3. Nothing on the Website shall be construed as:
(a) investment advice, financial advice or a recommendation or solicitation to buy, sell or hold any property, security or financial instrument;
(b) legal, tax, accounting or other professional advice;
(c) a guarantee of capital appreciation, rental yield, occupancy rate or any particular investment performance;

9. PROPERTY INFORMATION, PRICING AND AVAILABILITY
9.1. The Website may showcase properties, projects and opportunities in Dubai and other locations. Unless expressly stated in a signed agreement with you, all such information is illustrative, subject to contract and subject to change at any time without notice.
9.2. In particular:
(a) prices may be indicative, subject to currency fluctuations, applicable taxes, fees (including Dubai Land Department fees), payment plans and developer or seller conditions;
(b) availability, unit sizes, layouts, views, specifications, completion dates and incentives are subject to change, delay, cancellation or withdrawal by developers, owners or authorities;
(c) some images and renderings may be artistic impressions or concept visuals; actual appearance, finishes and views may differ.
9.3. It is your responsibility to verify all property details and contractual terms directly with us and/or the relevant developer, seller or landlord before making any commitment.
9.4. We are not responsible for any loss or damage arising from reliance on inaccurate, incomplete or outdated property information displayed on the Website, except to the extent required by mandatory law.
10. THIRD-PARTY LINKS AND SERVICES
10.1. The Website may contain links to third-party websites, apps or services (including developers, portals, payment gateways, social media platforms, advisors and partners) that are not owned or controlled by Global X.

11.2. “Global X”, “Global X Real Estate”, any associated logos, and related trade names and marks are trademarks or trade names of Global X or its group companies. Other names, logos and brand elements may be the trademarks of their respective owners.
11.3. Subject to these Terms, you may:
(a) access and view the Website and Content for your personal, non-commercial use in evaluating our services and properties; and
(b) print or download a limited number of pages for your personal use only, provided that you do not remove any copyright or proprietary notices.
11.4. You must NOT, without our prior written permission:
(a) copy, reproduce, modify, adapt, translate, distribute, publish, display, transmit, sell, license, or otherwise exploit any Content for commercial purposes;
(b) use any of our trademarks, trade names, logos or brand elements in any advertising, marketing or promotional materials;
(c) use framing, deep-linking, scraping or mirroring techniques to incorporate any part of the Website into another website;

12. USER-GENERATED CONTENT (IF ANY)
12.1. If the Website allows you to upload, submit or post any content (including comments, reviews, testimonials, enquiries, or other material) (“User Content”), you remain responsible for such User Content.
12.2. You warrant that:
(a) you own or have the necessary rights to submit the User Content;
(b) the User Content does not infringe any copyright, trademark, privacy, publicity or other rights of any person;
(c) the User Content is not defamatory, offensive, obscene, unlawful or otherwise objectionable;
(d) the User Content does not contain any viruses, malicious code or other harmful material.
12.3. By submitting User Content, you grant Global X a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such User Content in any media, for the purposes of operating, marketing and improving the Website and our services.
12.4. We reserve the right (but are not obliged) to monitor, edit or remove any User Content that we consider, in our sole discretion, to be in breach of these Terms or applicable law.
13. USE OF IMAGES, VIDEO AND BRAND ASSETS
13.1. The use of images, videos and other media on the Website is further described in our Privacy Policy. In summary, property images, event photos, videos, renderings and similar materials are used for marketing and brand communication purposes and may include incidental images of individuals, subject to applicable law and any consents obtained.
13.2. You may not download, copy, republish or reuse our images, videos, renderings or brand assets for your own marketing, advertising, listings or social media, unless you have obtained prior written permission from Global X.
13.3. Any unauthorised use of our images, videos or brand assets may result in legal action, including claims for damages and injunctive relief.
14. DISCLAIMER OF WARRANTIES
14.1. To the maximum extent permitted by applicable law, the Website and all Content are provided on an “as is” and “as available” basis, without any warranties of any kind, whether express, implied or statutory.
14.2. Without limiting the foregoing, we do not warrant that:
(a) the Website or Content will be accurate, complete, up-to-date or free from errors or omissions;
(b) the Website will be secure, uninterrupted or free from bugs, viruses or other harmful components;
(c) any particular results, returns, valuations or outcomes will be achieved by using the Website or acting on any Content.
14.3. We expressly disclaim all implied warranties of merchantability, fitness for a particular purpose, non-infringement and any warranties arising out of course of dealing or usage of trade.
15. LIMITATION OF LIABILITY
15.1. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable UAE law.
15.2. Subject to clause 15.1 and to the maximum extent permitted by law, Global X, its shareholders, directors, employees, agents and affiliates shall not be liable for:
(a) any indirect, consequential, special, incidental or punitive damages;
(b) any loss of profit, revenue, business, opportunity, goodwill or data;
(c) any loss or damage arising from:
(i) your reliance on any Content on the Website;
(ii) errors, inaccuracies or omissions in any property information, pricing or availability;
(iii) any delays, interruptions or failures of the Website;
(iv) viruses, malware, cyber-attacks or other harmful code transmitted via the Website by third parties;
(v) any acts or omissions of developers, owners, landlords, tenants, co-brokers or other third parties, even where introduced by us.
15.3. If, notwithstanding the above, we are found liable to you for any loss or damage arising out of or in connection with the Website or these Terms, our aggregate liability shall in no event exceed the greater of:
(a) the total amount (if any) paid by you to us specifically for access to or use of the Website during the six (6) months preceding the event giving rise to the claim; or
(b) AED 1,000,000 (one million United Arab Emirates dirhams).
16. INDEMNITY
16.1. You agree to indemnify, defend and hold harmless Global X, its shareholders, directors, employees, agents and affiliates from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or in connection with:
(a) your use of, or inability to use, the Website;
(b) your breach of these Terms or any applicable law;
(c) any User Content you submit;
(d) any infringement or violation of any rights of a third party by you.
16.2. We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defence of such claim.
17. GOVERNING LAW AND JURISDICTION
17.1. These Terms, and any dispute or claim arising out of or in connection with them or with your use of the Website (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates.
17.2. Subject to any mandatory provisions of law, the courts of Dubai (onshore) shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms or the Website.
18. ELECTRONIC COMMUNICATIONS AND RECORDS
18.1. You agree that communications and records in electronic form are valid and enforceable in the same manner as if they were in writing, in accordance with applicable UAE law on electronic transactions and commerce.
18.2. You consent to receive communications from us electronically (including by email, SMS, WhatsApp or notices posted on the Website) and agree that all such communications satisfy any legal requirement that such communications be in writing, to the extent permitted by law.
19. SEVERABILITY
19.1. If any provision of these Terms is found by a court or competent authority to be invalid, unlawful or unenforceable, such provision shall, to the extent required, be deemed deleted, and the remaining provisions shall continue in full force and effect.
20. ASSIGNMENT
20.1. We may assign, transfer or subcontract any of our rights and obligations under these Terms, in whole or in part, to any group company or third party, without prior notice.
20.2. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent.
21. ENTIRE AGREEMENT
21.1. These Terms, together with the Privacy Policy and any other notices or policies referenced herein, constitute the entire agreement between you and Global X in relation to your use of the Website and supersede any prior understandings or agreements, whether written or oral, relating to such subject matter.
